Terms & Conditions of Use
1.Acceptance of agreement
You (“Client”) agree to the terms and conditions outlined in this Terms and Conditions Agreement (“Agreement”) with respect to our site (“La Casa del Habano Samnaun”). This Agreement constitutes the entire and only agreement between La Casa del Habano Samnaun and the Client, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to La Casa del Habano Samnaun, the content, products or services provided by or through the La Casa del Habano Samnaun web site, and the subject matter of this Agreement. This Agreement may be amended by us at any time and from time to time without specific notice to the Client.
TERMS OF USE
THE CLIENT MUST BE 21 YEARS OF AGE OR OLDER TO PURCHASE TOBACCO PRODUCTS – La Casa del Habano Samnaun does not sell cigarettes of any kind. The purchase of tobacco products by a minor under 21 years of age and the provision of tobacco products to a minor are prohibited by law. A minor unlawfully purchasing or using tobacco products is subject to criminal penalties. Falsifying your age for the purpose of purchasing cigars is illegal.
La Casa del Habano Samnaun DOES NOT MARKET TO, NOR DOES La Casa del Habano Samnaun DELIVER TOBACCO PRODUCTS TO MINORS. If no one is available to sign for your package, we suggest shipping to your office or place of business or perhaps a neighbour.
La Casa del Habano Samnaun reserves the right to cancel any sale based on our sole discretion if we believe the Client is purchasing cigars on behalf of a minor. By clicking on any of the product links on the La Casa del Habano Samnaun web site, the Client is confirming that he is of legal age in his location of residence, and agrees that as part of the ordering process his age may be verified in available age verification databases.

Our suppliers change packaging and look of their products (bands, boxes, tubes, etc.) from time to time and the changes may not be reflected on our web site. La Casa del Habano Samnaun can not be held responsible for any typographical errors or image disparity on its web site.

2. Payment
The Client represents and warrants that if he is purchasing something from La Casa del Habano Samnaun that (i) any credit card information he supplies is true, correct and complete, (i) charges incurred by him will be honoured by your credit card company, and (iii) he will pay the charges incurred by him at the posted prices, including any shipping fees and applicable taxes.
The Client’s credit card will be pre-authorised in the amount of the order he placed, immediately after he submits his payment details. The Client will be billed ONLY after acceptance of his order by our sales staff and validation of his billing information, IP address, ISP and Bank information by our payments processor. In the event the Client’s order gets canceled, the pre-authorisation will get canceled AUTOMATICALLY and the funds will be released within 7-10 business days.
3. Tobacco Importation and Customs
Tobacco related laws differ from one country to another. There are countries where importation of Cuban goods may be prohibited. By placing an order with La Casa del Habano Samnaun, the Client confirms that he knows the applicable laws pertaining to the purchase and importation of Cuban Cigars from abroad to his shipping address. As the purchaser of the cigars from La Casa del Habano Samnaun, the Client takes on full legal responsibility for bringing the cigars into his country.
La Casa del Habano Samnaun does not assume ANY RESPONSIBILITY for ANY TAXES, delayed shipments, or any further inconveniences caused by domestic Customs offices. La Casa del Habano Samnaun is not in a position to be fully aware of all regulations pertaining to customs offices all over the world hence assumes that each Client is fully aware of the conditions and regulations applied by his domestic customs system.
In the event Customs returns the packages to our warehouse, we will issue a full refund if and when the package arrives in our warehouse in re-saleable condition.
4. Delivery Guarantee
Delivery is guaranteed except for situations that arise from Client error such as:
– Wrong or insufficient address
– Address change due to relocation or a move
– Unsuccessful delivery due to customer not being present at the delivery address
– Assumed loss of the package(s) after delivery (package tracking shows delivered but the Client says he has not received the package)
The Client acknowledges that NO REFUND IS DUE if the package does not get delivered to the Client due to one of the above reasons.
The delivery guarantee does NOT cover re-shipped packages as replacement for the non-delivered orders covered by the delivery guarantee. In other words, if La Casa del Habano Samnaun is re-shipping you a particular order due to a previous delivery issue, there is no refund of any kind, if the replacement package does not show up.
Last but not least, the delivery guarantee claim period is 3 months from the time the order has been shipped. Any claims beyond this period will not be honoured.
5. Return Policy
If goods are found to be defective or broken on arrival please contact us within 14 DAYS of receiving the cigars for an RMA (Return Merchandise Authorisation) before sending the cigars back to us. We will send a replacement or refund your money according to your preference as soon as the defective goods are received by us.
La Casa del Habano Samnaun ABSOLUTELY does NOT accept returns past the 14 DAYS. All return packages should be authorised by La Casa del Habano Samnaun prior to shipping and the Client must provide La Casa del Habano Samnaun with a tracking number immediately after sending the package(s).
6. Special Offers
Special offers are valid only as long as supplies last or until offers are terminated.
